Welcome to Kemi’s Jewel. These Terms and Conditions (“Terms”) govern your use of our website kemisjewel.co.uk (the “Website”) and the purchase of any products (“Products”) from us.
In these Terms, “we”, “us”, and “our” refer to Kemi’s Jewel. “You” and “your” refer to you, the user of our Website and/or customer.
By accessing our Website and/or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Website or purchase our Products.

2. The Contract
2.1. When you place an order on our Website, you are making an offer to purchase the specified Products.
2.2. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage.
2.3. We will send you an “Order Confirmation” email to acknowledge that we have received your order. This email does not mean your order has been accepted.
2.4. A legally binding contract between you and us will be formed only when we send you a “Dispatch Confirmation” email, which confirms that your Products have been shipped.
2.5. We reserve the right to refuse any order for any reason. This may be due to, but is not limited to, the Product being out of stock, a pricing or product description error, or our inability to obtain authorisation for your payment.

3.1. We take all reasonable care to ensure that all details, descriptions, and images of Products appearing on the Website are accurate. However, we do not warrant that the descriptions are error-free.
3.2. Jewelry Disclaimer: Many of our Products are made with natural materials (such as gemstones). Please be aware that this means there may be slight variations in colour, size, and texture. Images on the Website are for illustrative purposes, and your Product may vary slightly from those images.
3.3. All prices are set in Pounds Sterling (£) and are inclusive of VAT at the current UK rate.
3.4. Prices for our Products may change from time to time, but changes will not affect any order for which we have already sent a Dispatch Confirmation.
3.5. Delivery charges are not included in the Product price. The total delivery cost will be clearly displayed at checkout before you confirm your order.
3.6. In the event of a clear and obvious pricing error, we are under no obligation to provide the Product to you at the incorrect (lower) price, even after sending an Order Confirmation. We will contact you for instructions or cancel your order.
3.7. International Orders, Currency & Duties: * (a) Currency: We are a UK-based company and all transactions are processed in Pounds Sterling (GBP). If you are viewing our Website from outside the UK, prices may be displayed in your local currency for your convenience. These prices are for guidance only and are based on an approximate exchange rate. * (b) Final Price: The final amount you are charged will be in Pounds Sterling (GBP). Your card issuer or payment provider will perform the currency conversion. Please be aware that your provider may use a different exchange rate than the one displayed on our site and may charge you an additional processing or conversion fee. * (c) Import Duties & Taxes: If your order is being delivered outside the UK, it may be subject to import duties, customs fees, and/in local taxes levied by your country’s customs office. You, the buyer, are solely responsible for paying these charges. We have no control over these charges and cannot predict what they may be. We advise you to contact your local customs office for further information before placing your order.
4. Payment
4.1. Payment must be made in full at the time of order.
4.2. We accept payment via the methods shown at checkout (e.g., Visa, Mastercard, PayPal, etc.).
4.3. All card payments are processed through a secure payment gateway. We do not store your credit or debit card details. By placing an order, you confirm that the credit/debit card being used is yours.
4.4. All payments are processed in Pounds Sterling (GBP), as stated in section 3.7. Your order confirmation will show the GBP amount that has been charged.
5. Delivery
5.1. We will deliver the Products to the delivery address you provided in your order.
5.2. All delivery times quoted on the Website are estimates only. We will make every effort to deliver your goods within the estimated timeframe, but we are not liable for any delays caused by postal services or other events beyond our control.
5.3. Risk of loss and damage to the Products passes to you on the date when the Products are delivered to your address.
6. Your Right to Cancel (Cooling-Off Period)
This section applies to your rights under the Consumer Contracts Regulations 2013.
6.1. You have a legal right to cancel your contract for any reason within 14 days without giving any reason.
6.2. This cancellation period will expire 14 days from the day after you receive (or someone you nominate receives) your complete order.
6.3. To exercise the right to cancel, you must inform us of your decision in a clear statement (e.g., by email to welcome@kemisjewel.co.uk).
6.4. If you cancel the contract, you must return the Products to us at 24 Hatton Garden, London EC1N 8AN without undue delay, and in any event no later than 14 days from the day on which you informed us of your cancellation. You will be responsible for paying the direct cost of the return postage.
6.5. We will provide a refund (including the cost of our standard delivery, but not premium/express delivery) within 14 days of us receiving the returned goods back, or you providing proof of postage.
7. Returns & Refunds Policy
7.1. Hygiene Exception: For health and hygiene reasons, we cannot accept returns for earrings for pierced ears if the hygiene seal has been broken or removed, unless the item is faulty. This does not affect your statutory rights.
7.2. Condition of Return: All returned Products must be in their original, unworn, and undamaged condition, with all original tags and packaging intact.
7.3. We reserve the right to reduce your refund to reflect any reduction in the value of the goods if this has been caused by your unnecessary handling of them (i.e., handling them in a way that would not be permitted in a shop).
7.4. Personalised Items: Any Products that have been custom-made or personalised for you (e.g., engraved) cannot be returned or refunded unless they are faulty.
8. Faulty Goods
This section applies to your rights under the Consumer Rights Act 2015.
8.1. We are under a legal duty to supply Products that are of satisfactory quality, fit for purpose, and as described.
8.2. 30-Day Right to Reject: If your Product is faulty, you have the right to a full refund within 30 days of receiving the item.
8.3. After 30 Days: If a fault appears after 30 days (but within six months), you have the right to request a repair or replacement. If we are unable to repair or replace the item, you may be entitled to a full or partial refund.
8.4. This policy does not cover faults or damage caused by accidental damage, improper care, misuse, or normal wear and tear. We strongly advise you to follow any care instructions provided with your jewelry.
8.5. To report a faulty item, please contact us at welcome@kemisjewel.co.uk with your order number, a description of the fault, and photographic evidence.
9. Intellectual Property
9.1. All content on this Website, including but not limited to text, graphics, logos, images, and software, is the property of Kemi’s Jewel or its content suppliers and is protected by UK and international copyright laws.
9.2. You are not permitted to copy, reproduce, distribute, or use any of this content for commercial purposes without our express written permission.
10. Limitation of Liability
10.1. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
10.2. We will not be liable to you for any indirect or consequential loss, or for any loss of profit, revenue, or business opportunity, whether or not such losses were foreseeable.
10.3. Our total liability to you for all losses arising under or in connection with the contract shall be limited to the total price paid by you for the Products in that order.
10.4. We will not be liable for any failure or delay in performing our obligations where such failure or delay is caused by an event outside our reasonable control (a “Force Majeure Event”).

12. General
12.1. We may amend these Terms at any time by updating this page. The Terms in force at the time you place your order will be the ones that apply to your contract.
12.2. If any court finds that any part of these Terms is illegal or unenforceable, the rest of the Terms will continue in full force and effect.
12.3. These Terms, and any contract between us, shall be governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
